Basic Provisions
The controller of personal data under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter "GDPR") is Dáváme s. r. o., Company ID (IČ): 07058497, with its registered office at Bartůňkova 2349/3a, Chodov, 149 00 Prague 4 (hereinafter "controller").
Personal data refers to any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Sources and Categories of Processed Personal Data
The controller processes personal data you have provided or personal data obtained based on the fulfillment of your order. The controller processes your identification and contact details, and data necessary for the performance of the contract.
Legal Basis and Purpose of Personal Data Processing
The legal basis for processing personal data is the performance of a contract between you and the controller under Article 6(1)(b) of the GDPR, the legitimate interest of the controller in direct marketing (particularly for sending commercial communications and newsletters) under Article 6(1)(f) of the GDPR, your consent to processing for direct marketing purposes (particularly for sending commercial communications and newsletters) under Article 6(1)(a) of the GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, if no goods or services have been ordered.
The purpose of processing personal data is to process your order and exercise rights and obligations arising from the contractual relationship between you and the controller. Personal data is required when placing an order (name, address, contact information); providing personal data is a necessary requirement for concluding and fulfilling the contract. Without providing personal data, the contract cannot be concluded or fulfilled by the controller. It also serves the purpose of sending commercial communications and conducting other marketing activities.
Data Retention Period
The controller stores personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to enforce claims from these contractual relationships (for 5 years after the end of the contractual relationship).
Personal data processed based on your consent for marketing purposes will be retained until the consent is withdrawn, but no longer than 5 years.
After the data retention period expires, the controller will delete the personal data.
Recipients of Personal Data (Controller’s Subcontractors)
Recipients of personal data include persons involved in the delivery of goods/services or the realization of payments under the contract, as well as those involved in operating services and providing marketing services.
The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing and cloud services.
Your Rights
Under the conditions set by the GDPR, you have the right to access your personal data under Article 15 GDPR, to rectify personal data under Article 16 GDPR, to restrict processing under Article 18 GDPR, to restrict processing under Article 18 GDPR, to have personal data erased under Article 17 GDPR, to object to processing under Article 21 GDPR, to data portability under Article 20 GDPR, twithdraw consent to processing at any time, in writing or electronically to the controller’s address or email provided in Section III of these terms.
You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your data protection rights have been violated.
Conditions for Securing Personal Data
The controller declares that all appropriate technical and organizational measures have been taken to secure personal data. The controller has implemented technical measures to secure data storage and storage of personal data in paper form. The controller declares that personal data can only be accessed by authorized persons.
Final Provisions
By submitting an order through the online form, you confirm that you have read and fully accept these personal data protection terms. The controller is entitled to amend these terms. A new version of the personal data protection terms will be published on the controller’s website, or sent to your provided email address.
